1. Agreement to Terms

By accessing or using ThePutWorks ("the Platform," "our service," or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our platform. These Terms apply to all visitors, users, and others who access or use the service.

Content Standards: All content must comply with our community guidelines. Content that is illegal, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable is prohibited.

Content Removal: We reserve the right to remove, modify, or refuse to display any content that violates these Terms or our community guidelines, without prior notice and at our sole discretion.

Intellectual Property: You must respect the intellectual property rights of others. Do not upload content that infringes on copyrights, trademarks, or other proprietary rights.

4. Account Termination

Termination by You: You may terminate your account at any time by contacting our support team or using the account deletion feature in your profile settings.

Termination by Us: We may suspend, disable, or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Prolonged inactivity
• Technical or security reasons

Effect of Termination: Upon termination, your right to use the platform will cease immediately. We may delete your account and all associated data in accordance with our data retention policies.

5. Limitation of Liability

Service Availability: ThePutWorks is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, secure, or error-free.

Disclaimer: To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages: In no event shall ThePutWorks, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the platform.

Maximum Liability: Our total liability to you for any damages arising from or related to these Terms or your use of the platform shall not exceed the amount you have paid us in the twelve (12) months preceding the incident.

6. Governing Law

Applicable Law: These Terms and any disputes arising out of or related to these Terms or the platform shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law principles.

Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Makwanpur, Nepal, and you hereby consent to personal jurisdiction and venue therein.

International Users: If you are accessing our platform from outside Nepal, you are responsible for compliance with local laws in your jurisdiction.

7. Changes to Terms

Modification Rights: We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the platform or via email at least 30 days before the changes take effect.

Acceptance of Changes: Your continued use of the platform after any changes to these Terms constitutes acceptance of those changes. If you do not agree to the modified Terms, you must stop using the platform.

Waiver: No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term.
